Modification of Manual Worker Timely Payment Penalty Rule

The Governor of New York signed an amendment into law on May 9, 2025, modifying the penalties imposed on employers who fail to pay manual workers weekly. It immediately went into effect. An answer to a FAQ stated that individuals spending over 25% of working time engaged in physical labor are considered manual workers.

The law applies to private sector employers and excludes individuals working in an executive, administrative, or professional capacity as defined in the FLSA. Employers may face penalties for first and repeat violations of this pay schedule requirement.
