Pay Disclosure Requirement in Delaware

Under new legislation enacted in Delaware, employers with 25+ employees must include specific details about benefits and compensation in external and internal job postings. It is slated to go into effect on September 26, 2027. This law applies to postings for jobs located in Delaware and positions offered by employers based in the state (as long as they are not international roles).

The required information includes:

  • Hourly or salary compensation amount or range
  • General description of other compensation and benefits as applicable

If a job will be paid partially or fully on commission basis must indicate this fact and that it is not required to disclose the compensation or range. The same is true of jobs paid on a tipped basis, although the base wage or range must be included in the listing.

Employers may not discriminate against or discharge individuals based on making complaints or providing information to the DOL or starting or testifying in legal proceedings.
